Big Tech’s Reckoning: Australia’s Moment to Lead Against Algorithmic Harm

Australia is approaching a decisive moment in the governance of digital power. The recent United States jury verdict finding Meta and Google liable for the addictive design of their platforms is not a discrete legal event. It represents a structural shift in how advanced economies will define responsibility in the digital age. For Canberra, this is a call to act with clarity and urgency. For the technology sector, it is a warning: the era of unbounded optimisation has ended.

During the past week, a Los Angeles jury found that platform design features such as infinite scroll, autoplay and algorithmically timed notifications were intentionally engineered in ways that contributed to harm, particularly for younger users. Liability was apportioned between the companies, with damages awarded. The financial quantum is immaterial. What matters is the doctrine established: algorithmic design can constitute a defective product.

This reframing is profound. For two decades, digital platforms have operated within a regulatory perimeter that focused on content. What is posted, shared or amplified has been the centre of policy debate. This case shifts the focus decisively to system architecture. It asserts that harm can be embedded in the logic of the system itself, not just in the material that flows through it.

The implication is clear: the attention economy – the model that converts human focus into revenue – is now subject to the same scrutiny as any other industry whose products shape behaviour at scale.

For Australia, this development arrives at a moment of increasing strategic awareness about the role of technology in national resilience. Our economy, our institutions and our social fabric are deeply integrated with global platforms. Yet our regulatory frameworks remain largely reactive, centred on moderation, takedown and access controls. These are necessary, but they are no longer sufficient.

The emerging global standard is design accountability.

The United States is arriving at this point through litigation. The European Union is advancing through regulation, with instruments such as the Digital Services Act targeting systemic risks and platform design practices. Australia now faces a choice: it can continue to operate within a content-centric paradigm, or it can move decisively to establish a duty of care in design – a framework that treats algorithmic systems as products subject to safety obligations.

This is not theoretical. The legal pathway has now been demonstrated. The case is widely understood as a "bellwether" among thousands of similar claims in the United States. Australian law firms have already begun assessing the viability of domestic actions. The barrier to litigation has lowered. The precedent exists. The question is no longer whether similar cases will emerge in Australia, but when – and under what legal architecture.

If Australia does not define that architecture, it will inherit it.

For government, the strategic imperative is threefold.

First, recognise that algorithmic systems are now part of Australia's critical infrastructure. They shape information flows, influence behaviour and increasingly mediate decision-making across sectors. Under the Security of Critical Infrastructure Act, boards and executives are already accountable for managing systemic risk. It is a logical extension to consider whether algorithmic design – particularly where it demonstrably affects societal stability – falls within that responsibility.

Second, move beyond harm mitigation to harm prevention. Current frameworks emphasise responding to adverse outcomes. The emerging model requires systems to be safe by design. This includes default settings that minimise exploitative engagement, transparency around recommendation systems and safeguards for vulnerable users. These are not constraints on innovation; they are conditions for sustainable legitimacy.

Third, align regulatory ambition with economic strategy. Australia has an opportunity to position itself as a jurisdiction that integrates technological capability with governance excellence. This is consistent with broader national objectives around sovereign capability, critical technologies and institutional resilience. It requires coordination across government, industry and academia, and a willingness to set standards rather than follow them.

For the technology sector, the message is equally direct.

The operating environment has changed. The assumption that engagement optimisation is inherently benign is no longer defensible. Courts and regulators are now prepared to interrogate the intent and impact of design choices. Features that maximise time-on-device may be reclassified as mechanisms that exploit cognitive vulnerabilities. The distinction between innovation and liability will be drawn at the level of code.

This introduces a new discipline. Product development must incorporate legal, ethical and societal considerations from inception. Governance structures must evolve to provide oversight of algorithmic design, not just financial performance. Investment decisions must account for the possibility that core engagement mechanisms will be constrained or prohibited.

The alternative is exposure to litigation, to regulatory intervention and to a loss of public trust that is far more difficult to recover.

There is also a deeper strategic dimension.

The digital environment is now a primary theatre in which national resilience is shaped. The same systems that drive engagement can amplify misinformation, polarisation and strategic narratives. They influence how citizens perceive events, assess risk and respond to crisis. In this context, the design of algorithmic systems is not simply a commercial matter; it is a question of national capability.

Australia cannot afford to be a passive consumer of these systems.

We must develop the capacity to understand, evaluate and, where necessary, constrain the design logic of the platforms that operate within our jurisdiction. This includes investing in technical expertise within government, strengthening regulatory institutions and engaging constructively but firmly with industry.

The objective is not to diminish the value of technology. It is to ensure that its deployment aligns with Australia's long-term interests.

The Meta – Google verdict marks the beginning of a new phase in the evolution of the digital economy. It signals that the architecture of platforms is now subject to legal accountability, that the economics of attention are open to challenge and that the balance between innovation and responsibility is being recalibrated.

For Australia, this is a moment to lead.

To Canberra: the window for shaping this domain is open, but it will not remain so indefinitely. The frameworks we establish now will determine how technology interacts with our society, our economy and our national security for decades to come.

To the technology sector: the licence to operate in advanced economies will increasingly depend on your ability to demonstrate that your systems are not only powerful, but safe, transparent and aligned with societal expectations.

The line has been drawn. The question is whether Australia chooses to stand at the forefront of this shift – or to be shaped by it.
